ADVANCED BIO-TECHNOLOGIES, INC. DECLARED OWNER OF KELO-COTE TRADEMARK
Los Angeles, CA. In a Judgment entered on June 5, 2000, the Honorable Lourdes G. Baird of the United States District Court for the Central District of California declared that Advanced Bio-Technologies, Inc. is the owner of the "Kelo-cote" trademark used in connection with its patented topical gel scar management product. Advanced, based in Silverdale, Washington, is the successor in interest to the "Kelo-cote" business of the former Applied Biomaterial Technologies, Inc. (aka ABT), the developer of "Kelo-cote." In the June 5, 2000, Judgment, Judge Baird confirmed that Advanced is "the lawful owner of the mark Kelo-cote" and found that Allied Biomedical Corporation has infringed upon Advanced's rights by marketing and selling a competing scar management gel under the name "Kelocote."
Judge Baird entered a permanent injunction prohibiting Allied, "its officers, directors, agents, employees, and all those acting in concert with any of them, . . . from manufacturing, copying, duplicating, selling, marketing, advertising, distributing, or otherwise disposing of any products using the "Kelocote" trademark or any mark confusingly similar thereto." A jury trial has been set for August 29, 2000, to determine the amount of damages that Advanced should be awarded for Allied's infringement and to determine whether Allied's infringement was willful.
